The following words and phrases have these meanings in this document:
1.1. Baobab Web Services (Pty) Ltd ("BWS", "Us", "We" or "Our") a company incorporated in terms of the company laws of the Republic of South Africa. Address: 35-38 Buena Vista Office Park, 1 Heuwelkruin Close, Eversdal, 7550, Western Cape, South Africa. Email: firstname.lastname@example.org.
1.2. "Website" or "Site" includes the web entity https://www.bwscloud.tech, as well as the various services provided by Baobab Web Services (Pty) Ltd to you, the User, subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the "Acceptable Use Policy"), as well as any other written agreement between you and BWS.
2.1. BWS reserves the right to amend this Acceptable Use Policy at any time. You are expected to check this page from time to time to take notice of any changes made, as they are legally binding on you and form part of your contract with BWS. BWS reserves the right to immediately, and without notice, take down or disable any hosting account that violates this policy. BWS' failure to enforce this policy, for whatever reason, shall not be construed as a waiver of BWS' rights to do so.
3.1. You agree to utilise BWS' Hosting Platform, and Services may only be used for lawful purposes. You may not use BWS' Website or services in any way that:
3.1.1. Breaches any applicable local, national or international law or regulation;
3.1.2. Is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
3.1.3. Promotes violence;
3.1.4. Promotes sexually explicit material;
3.1.5. Promotes any illegal activity;
3.1.6. Discrimination based on, but not limited to, race, sex, religion, nationality, disability, sexual orientation or age;
3.1.7. Infringes any copyright, trademark or another intellectual property right of any other person;
3.1.8. Is obscene, offensive, hateful or inflammatory;
3.1.9. Causes service interruptions to either BWS’ network/servers or any outside network. Interruptions include, but is not limited to, the execution of Denial of Service attacks or other maliciously configured software;
3.1.10. Collect or use email addresses, screen names or other personal identifiers without the consent of the person identified (including, without limitation, phishing, Internet scamming, password robbery, spidering, and harvesting);
3.1.11. Impersonate another person or entity, be it through Email, Internet Forums, or any other means. This includes spoofing email or network packet headers whether or not it is done for malicious purposes;
3.1.12. Promotes or discusses hacking activities or tools;
3.1.13. Results in an IP address allocated to BWS being blacklisted;
3.1.14. Transmit any data that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, malware or any other harmful programs or similar computer code designed to affect the operation of any computer software or hardware adversely; and
3.1.15. Sends or transmits unsolicited communication (spam) of any form by any means (including but not limited to, emails, SMS (texts), WhatsApp or additional future communication channels).
3.2. You also agree not to utilise any of the services/platforms/software listed below as these are not allowed on any service or platform provided by us:
3.2.1. IRC Bots/Bouncers;
3.2.2. BitTorrent software;
3.2.3. Network Daemons;
3.2.4. Proxies (anonymous or otherwise);
3.2.5. Any abusive script/process; and
3.2.6. Mirroring services.
4.1. Users may not execute/run any program or script by any means (including but not limited to cronjobs, scripts or interactive commands) that consumes more than:
4.1.1 128MB of memory space;
4.1.2 30 CPU seconds or 25% of any 1 CPU core;
4.1.3 10 simultaneous processes; and
4.1.4 Send out mail to more than 500 recipients/email addresses within one hour. The recipient count is any combination of the total number of recipients for all emails sent within the given period regardless of whether sent as 1 email with multiple recipients on individual emails.
5.1. No hosting account is allowed more than 250 000 files; this is to ensure optimum performance.
6.1. BWS’ hosting platforms are not intended to be used for data backup or archiving purposes.
7.1. Complaints should be directed to email@example.com. Please ensure you provide as much detail as possible, including a timeline of events if applicable. The complaint will be reviewed by a manager who may contact you for additional information if required. BWS will do everything to try and resolve any issue raised.
